PokePower processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: General Data Protection Regulation), as well as national personal data protection regulations.

The PokePower online store uses appropriate technological and organizational measures to protect the transmission and storage of personal data, orders, and payments. The purchase contract (order) is stored electronically on the provider’s server.

PokePower is committed to the permanent protection of all user personal data. The provider will use personal data exclusively for the purposes of fulfilling the order (sending informational materials, offers, invoices) and other necessary communication. To register or create a user account, the user must provide PokePower with mandatory personal data: first name, last name, email address, password, and optionally, a phone number.

PokePower will process customers’ personal data for the purposes of:

  • Contacting the user to ensure smooth use of goods or services subject to these General Terms,
  • Providing goods or services subject to the general terms and concluding a contract with the user,
  • User registration,
  • Verifying the user’s identity,
  • Executing and reviewing payment transactions, any discrepancies in payment execution, and related abuses or breaches of these General Terms.

PokePower will process customer data for other purposes only if the user has given consent for such purposes, including:

  • User profiling to prepare personalized offers of goods and services using email, SMS, MMS, phone, or traditional mail,
  • Direct marketing regarding offers of goods and services, promotional sales, discounts, and other changes or updates,
  • Conducting market research on product and service quality and needs for additional products or services.

For each purchase by a registered user, PokePower also processes data on purchased products or services, regular price, discounted price, savings, earned or used benefits and other advantages, product availability, purchase time, payment methods, credits, data on pick-up at the point of sale including time and place of pick-up, name of the pick-up person (if different from the registered user who placed the order), delivery time and place, payment price, payment method, and order number. PokePower processes this data to fulfill contractual obligations in the online store.

If the individual does not give appropriate consent for such processing, PokePower processes these data anonymously, including for analyzing and studying shopping habits to optimize offers, costs, and increase customer satisfaction.

Types of Personal Data, Legal Basis, and Purpose of Processing – Applies to Guests Only


When purchasing as a guest, the individual must provide PokePower with their personal data: first name, last name, phone number, permanent or temporary residence address, and email address.

PokePower will process guest personal data for the purposes of:

  • Contacting the guest to ensure smooth execution of services subject to these terms,
  • Providing goods or services subject to these terms and concluding a contract with the guest,
  • Executing and reviewing payment transactions, any discrepancies in payment execution, and related abuses or breaches of these terms.

Regarding purchases made as a guest, PokePower also processes agreement to these terms. To prove acknowledgment of these terms, PokePower processes confirmation, time of confirmation, and IP address.

For each purchase by a guest, PokePower also processes data on purchased products or services, regular price, discounted price, savings, earned or used benefits and other advantages, product availability, purchase time, payment methods, credits, data on pick-up at the point of sale including time and place of pick-up, name of the pick-up person (if different from the guest who placed the order), delivery time and place, payment price, payment method, and order number. PokePower processes these data to fulfill contractual obligations in the online store.

Types of Personal Data, Legal Basis, and Purpose of Processing – Applies to Consumers Only

To comply with legal obligations relating to the consumer’s right of withdrawal, PokePower processes the following personal data under the valid Consumer Protection Act: first name, last name, street, city, postal code, phone, email, bank account number, order number, date of receipt of goods, and goods subject to withdrawal.

To comply with legal obligations relating to the consumer’s right to lodge a complaint, PokePower processes the following personal data under the valid Consumer Protection Act: first name, last name, street, city, postal code, phone, email, bank account number, order number, date of receipt of goods, date of fault detection, date of return of goods, date of complaint filing, description of the fault, customer request.

For user identification in the cases described above, an authorized contractual partner may request to see the user’s personal identification document but will not record the data.

PokePower may process all the mentioned data in pseudonymized form, as well as user feedback on their experience with PokePower online store, based on legitimate interest, for the purpose of analyzing and studying shopping habits to optimize offers and costs and increase customer satisfaction.

User Rights

Users may at any time request confirmation whether PokePower processes their personal data and access these personal data. They have the right to receive their personal data and the right to transmit them to another controller. Users may request restriction of processing, object to processing of personal data and automated decision-making including profiling, withdraw consent given for data processing based on consent, request corrections or amendments, or deletion of personal data. These rights may be exercised under the terms and scope of Articles 15 to 22 of the General Data Protection Regulation.

Regardless of the right to deletion, personal data may still be processed based on other legal grounds if such grounds exist under Article 6 of the GDPR (e.g., data processed based on tax laws or contracts with PokePower cannot be deleted).

When exercising the rights to object to processing, withdraw consent, request restriction, or deletion of personal data that result in stopping notifications, PokePower will stop notifications within 15 days of receiving the objection or change. If a notification campaign was prepared before the objection or change, the user may still receive a final notice. PokePower will ensure the exercise of other rights within the deadlines required by applicable personal data protection legislation.

Data Retention Period

Unless otherwise specified in these terms and conditions, PokePower processes personal data until the purpose of processing is fulfilled or within the limitation periods for obligations that may arise from the processing of such personal data. In cases where the retention period of personal data is determined by law, PokePower stores such personal data in accordance with the legal requirements. Personal data obtained on the basis of consents are retained until the consent is withdrawn.

PokePower processes the following personal data of guests until the order is fulfilled: first name, last name, permanent or temporary address, phone number, and email address. After the order is fulfilled, PokePower processes the guests' personal data listed in the previous sentence only in connection with the specific order, which can only be accessed by knowing the invoice number and the order number.

PokePower does not process personal data of persons who visit the PokePower online store and do not make a purchase and will immediately delete such data.
